East Coast Asphalt Supply accused of not paying per agreement

PITTSBURGH -- Labor funds are suing East Coast Asphalt Supply Inc. a/k/a ECAS and East Coast Paving & Seal Coating Inc., alleging breach of contract by the employer.

Laborers' Combined Funds of Western Pennsylvania, as agent for Philip Ameris; and Paul V. Scabilloni, trustees ad litem; Laborers' District Council of Western Pennsylvania Welfare and Pension Funds; the Western Pennsylvania Heavy & Highway Construction Advancement Fund; and the Laborers' District Council of Western Pennsylvania and its affiliated local unions filed a complaint on Oct. 4 in the U.S. District Court for the Western District of Pennsylvania against the defendant. They allege it failed to make timely monthly contributions to the funds.

According to the complaint, the plaintiffs allege they suffered damages from unpaid and late contributions. The plaintiffs hold the defendant responsible for allegedly breaching a bargaining agreement with the labor funds by failing to pay contributions on behalf of its employees.

The plaintiffs seek to enjoin the defendant from further violating the terms of the agreement, money judgment plus interest at the rate of 1.25 percent per month, liquidated damages at 10 percent times the principal amount, auditing fees and attorneys' fees equal to 20 percent of the total delinquency but not less than $1,000, court costs and any further relief this court grants.
