PHILADELPHIA — A man is suing Rite Aid HDQTRS Corp., d/b/a Rite Aid Corporation; and First Advantage LNS Screening Solutions Inc., d/b/a First Advantage Background Services Corp., alleging breach of duty and negligent misrepresentation in connection with a background check.

Josh Morley filed a complaint on Oct. 31 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that First Advantage provided an inaccurate criminal conviction report to Rite-Aid, which then rescinded an offer of employment to the plaintiff.

According to the complaint, the plaintiff alleges that he lost a job opportunity and suffered damages to his reputation. He alleges that First Advantage falsely reported a summary offense conviction under the "Felony & Misdemeanor" section of a report and incorrectly reported the date of the proceedings. The plaintiff holds the defendants responsible presenting false information and then acting on it.

The plaintiff requests a trial by jury and seeks damages not less than $100 and not more than $1,000 per violation, actual damages, punitive damages, court costs, real damages not less than $100 for each violation, exemplary and punitive damages not less than $1,000 and not more than $10,000 for each violation, court costs and any further relief this court grants.
