Woodstream Corp. alleges hummingbird feeder design was unlawfully copied

PHILADELPHIA – A Lititz company alleges a Denver business copied its hummingbird feeder design without authorization.

Woodstream Corp. filed a complaint on Nov. 4 in the U.S. District Court for the Eastern District of Pennsylvania against Classic Brands LLC alleging trade dress infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds Classic Brands LLC responsible because the defendant allegedly copied plaintiff's "pinch waist" feeder design and incorporated it on its products.

The plaintiff requests a trial by jury and seeks injunctive relief. It is represented by Theodore H. Jobes of Fox Rothschild LLP in Philadelphia.
