South Middleton Township Municipal Authority accused of breaching contract

HARRISBURG — An insurance firm is suing South Middleton Township Municipal Authority, alleging breach of contract.

Liberty Mutual Insurance Company filed a complaint on Nov. 8 in the U.S. District Court for the Middle District of Pennsylvania against South Middleton Township Municipal Authority, alleging that the defendant refused to accept responsibility for delay of a project as well as damages.

According to the complaint, the plaintiff alleges that it suffered monetary damages. The plaintiff holds South Middleton Township Municipal Authority responsible because the defendant allegedly failed to pay the plaintiff upon completion of a wastewater treatment plant project in which the plaintiff secured a second contractor after the defendant's change orders and the original contractor's losses required a new contractor to be secured.

The plaintiff seeks judgment against the defendant in the amount of $1,880,000 plus interest, court costs and any further relief this court grants. It is represented by Amy E. Bentz of Bentz Law Firm, P.C. in Pittsburgh.
