Mercury Insurance Group accused of improperly denying claim

PITTSBURGH — Two guardians and personal representatives of a minor child are suing Mercury Insurance Group, alleging breach of contract.

Ohio residents Charles Flenory and Cynthia Hamer, as guardians and personal representatives of ChaKira Flenory, filed a complaint on Oct. 20 in the Court of Common Pleas of Allegheny County against Mercury Insurance Group, alleging that the insurer wrongly refused to pay the medical expenses of ChaKira Flenory.

According to the complaint, the plaintiffs allege that Chakira Flenory sustained serious physical injuries as the result of a vehicle collision. The plaintiffs hold Mercury Insurance Group responsible because the defendant allegedly failed and refused to pay the plaintiffs for medical expenses under a policy issued to Charles Flenory.

The plaintiffs request a trial by jury and seek judgment against the defendant for compensatory damages, punitive damages, interest, treble damages, court costs and any further relief this court grants. They are represented by Eric T. Chaffin and Patrick Booth of Chaffin Luhana LLP in Pittsburgh.
