Progressions Behavioral Health Services Inc. employees allege they are owed overtime wages

PHILADELPHIA – Three employees of a Plymouth Meeting business have filed a class action suit over claims they were misclassified as independent contractors and not paid for overtime work.

Sarina Brown, April Walker and Michelle Aaron filed a complaint on Nov. 17 in the U.S. District Court for the Eastern District of Pennsylvania against Progressions Behavioral Health Services Inc., citing the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

According to the complaint, the plaintiffs allege that they worked for more than 40 hours per workweek but were not paid any overtime compensation. The plaintiffs hold Progressions Behavioral Health Services Inc. responsible because the defendant allegedly failed to pay the plaintiffs any overtime premiums at a rate of time-and-one-half for working more than 40 hours per week.

The plaintiffs request a trial by jury and seek award amounts due to them, unpaid employee benefits plus interest, liquidated damage of 25 percent, court costs and any further relief the court grants. They are represented by Michael Murphy and Michael Groh of Murphy Law Group LLC in Philadelphia.
