Panther Sales, AP Metal Sales accused of breaching contract

PITTSBURGH — Labor funds are suing Panther Sales Inc. and AP Metal Sales LLC, alleging breach of contract by the employers.

Greg Christy and William C. Ligetti, on behalf of the Trustees of the Iron Workers Welfare Plan of Western Pennsylvania, Iron Workers of Western Pennsylvania Pension Plan and the Iron Workers of Western Pennsylvania Profit Sharing Plan, and as agents for The Ironworkers Employers Association of Western Pennsylvania Inc., The International Association of Bridge, Structural and Ornamental Iron Workers, Local Union No. 3, AFL-CIO, filed a complaint on Nov. 22 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging that they failed to make their monthly benefit contribution to the plaintiffs.

According to the complaint, the plaintiffs allege that they suffered damages from unpaid and late paid contributions. The plaintiffs hold the defendants responsible because they allegedly breached their bargaining agreement with the plaintiffs by failing to pay their fringe benefit contribution the plaintiffs on behalf of employees.

The plaintiffs seek monetary judgment of at least $101,208.53 plus interest, court costs and any further relief this court grants. They are represented by Jeffrey J. Leech and Neil J. Gregorio of Tucker Arensberg, P.C. in Pittsburgh.
