Guaranty Bank claims heirs failed to pay mortgage

PITTSBURGH — A financial institution is suing several heirs of a woman, alleging breach of contract in a mortgage.

Guaranty Bank filed a complaint on Oct. 24, in the Court of Common Pleas of Allegheny County against surviving heirs of Michelle Heinbaugh, alleging that they failed to make mortgage payments.

According to the complaint, the plaintiff alleges that it suffered monetary damages. The plaintiff holds the defendants responsible because they allegedly failed to pay the principal balance of the mortgage, causing it to go into default.

The plaintiff seeks judgment against the defendant in the sum of $43,279.91 plus interest, court costs and the foreclosure and sale of the mortgaged property. It is represented by Jacob M. Ottley of McCabe, Weisberg & Conway, P.C. in Philadelphia.
