Bayada Home Health Care Inc. accused of not paying employees overtime

SCRANTON – A Luzerne County home health clinician has filed a class action lawsuit against her former employer over allegations that she was not paid overtime.

Stephanie Higgins filed a complaint on behalf of all others similarly situated on Nov. 30 in the U.S. District Court for the Middle District of Pennsylvania against Bayada Home Health Care Inc. citing violation of the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

According to the complaint, the plaintiff alleges that she worked for more than 40 hours per week without being paid any overtime compensation. The plaintiff holds Bayada Home Health Care Inc. responsible because the defendant allegedly misclassifed her and other employees as overtime-exempt and failed to pay the plaintiff any overtime premium for working more than 40 hours per week.

The plaintiff requests a trial by jury and compensatory damages, interest, court costs and any further relief the court grants. She is represented by David J. Cohen, James B. Zouras, Ryan F. Stephan and Teresa M. Becvar of Stephan Zouras LLP in Philadelphia.
