Inmate alleges medications were wrongfully taken away

PITTSBURGH – An inmate at State Correction Institute at Pittsburgh alleges he has been denied pain medication he was prescribed after a surgery.

David Payo filed a complaint on Nov. 3 in the Court of Common Pleas of Allegheny County against Pennsylvania Department of Probation and Parole, Parole Officer Peters and Supervising Agent Tom Bondy alleging violation of the Eighth and 14th Amendments.

According to the complaint, the plaintiff alleges that he had surgery on his spine in February and was prescribed pain medication. He alleges the defendants stopped him from receiving the medication two months later.

The plaintiff holds Pennsylvania Department of Probation and Parole, Peters and Bondy responsible because the defendants allegedly caused the plaintiff unnecessary pain and suffering.

The plaintiff requests a trial by jury and seeks compensatory damages of $100,000, punitive damages of $50,000, and any further relief the court grants. He is representing himself.
