Husband and wife sue insurance firm

PITTSBURGH — A married couple's lawsuit against Mike Dudenas Agency and State Farm Mutual Automobile Insurance Company alleges breach of contract and negligence.

Lisa Jo Mathews and Thomas J. Mathews Jr. filed a complaint on Nov. 7 in the Court of Common Pleas of Allegheny County against the defendants, alleging that they failed to offer a stacking option to the plaintiffs regarding their insurance policy.

According to the complaint, the plaintiffs allege that Lisa Jo Mathews and Thomas J. Mathews Jr. suffered monetary damages as the result of their insurance policy not being stacked when Lisa Jo Mathews was involved in a vehicular crash. 

The plaintiffs hold the defendants responsible because the defendants allegedly offered separate insurance policies to spouses instead of giving them the option to stack their policy to double the amount of their insurance coverage.

The plaintiffs seek judgment against the defendants in an amount that exceeds the jurisdictional limits of this court plus interest and court costs. They are represented by Thomas D. Berret of Hal K. Waldman & Assoc., LLC in Pittsburgh.
