USA Mobile Commissary accused of not providing truck or refund

PITTSBURGH — A Pittsburgh-area organization is suing USA Mobile Commissary Inc. and company official Gary Koppelman, alleging breach of contract and unjust enrichment.

Greater Pittsburgh Community Food Bank filed a complaint in the Court of Common Pleas of Allegheny County against the defendants, alleging that the failed to provide a customized step van to the plaintiff based on their agreement.

According to the complaint, Greater Pittsburgh Community Food Bank claims that it suffered monetary damages from paying an initial deposit of $57,00 and not getting the customized step van it paid for. The plaintiff holds the defendants responsible for allegedly failing to provide the van as agreed or to return the deposit.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount that exceeds the jurisdictional limits of this court plus interest and court costs. It is represented by Zachary P. Fenstemaker of Marcus & Shapira, LLP in Pittsburgh.
