HARRISBURG – A former employee is suing Best Buy Inc., district manager John Arias and human resources manager Cindy Kemmerly, employer, alleging disability discrimination in violation of the Family and Medical Leave Act and retaliation.
Sorin Ungurean filed a complaint on Jan. 10 in the U.S. District Court for the Middle District of Pennsylvania against the defendants, alleging that they terminated his employment for exercising his rights to FMLA leave.
According to the complaint, the plaintiff alleges that he was terminated from his employment for taking a leave of absence protected by the FMLA. The plaintiff holds the defendants responsible for allegedly terminating his employment for purported "lack of performance" despite being on an FMLA-protected leave.
The plaintiff requests a trial by jury and seeks compensation for back pay, front pay, lost benefits and wages, compensatory, statutory and punitive damages, court costs plus interest and any further relief this court grants. He is represented by Stephen J. Fleury, Jr., and Daniel M. Lieberman of Devine Law Offices, LLC in Lancaster.
