Friendly's Ice Cream accused of violating wage laws

PHILADELPHIA — A former Friendly's Ice Cream employee has filed a class-action lawsuit against Friendly's Ice Cream LLC; Fort Washington PA 693 LLC; Friendly's Restaurant - Norristown PA (897) LLC; Khaled Kezbari; and Doe defendants 1-10, alleging violation of the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

Christopher Walter filed a complaint on Jan. 12 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging that they failed to properly compensate the plaintiff and others for their work.

According to the complaint, the plaintiff alleges that he worked as a "server" but was not paid minimum wages or overtime wages during his employment. The plaintiff holds the defendants responsible for an alleged failure to follow the law on a "tip credit" and for having him work "off the clock" to avoid paying overtime wages.

The plaintiff requests a trial by jury and seeks an injunction against the defendants, unpaid minimum wages, unpaid overtime wages, liquidated damages, court costs and any further relief this court grants.
