Speedway LLC blames surveyor for increased construction costs, delay in opening

PITTSBURGH — A Pennsylvania corporation is suing Eastham & Associates; Eastham & Associates of Ohio LLP; and land surveyor Ronald L. Eastham, individually and d/b/a Easthman & Associates, alleging professional negligence, breach of warranty and breach of contract.

Speedway LLC filed a complaint on Dec. 1 in the Court of Common Pleas of Allegheny County against the defendants, alleging that the plaintiff was damaged as a result of an error in a professional survey at a gas station/convenience store site in North Versailles.

According to the complaint, the plaintiff alleges that Speedway LLC incurred monetary damages due to the increased construction costs and lost profits due to the delay of the project. The plaintiff holds Eastham & Associates; Eastham & Associates of Ohio, LLP; and Ronald L. Eastham, and d/b/a Easthman & Associates responsible because the defendants allegedly failed to properly perform the work in a workmanlike manner based on their agreement with the plaintiff.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that exceeds $35,000 plus interest, court costs and any further relief this court grants. They are represented by Rebecca Sember Izsak and Jeffrey T. Criswell of Thomas, Thomas & Hafer LLP in Pittsburgh, Pennsylvania.
