Banom Inc. claim infringement of its glove trademark

PHILADELPHIA — A Pennsylvania corporation is suing Direct Tools & Fasteners Inc., a California corporation, alleging trademark infringement and unfair competition.

Banom Inc. filed a complaint on Jan. 17 in the U.S. District Court for the Eastern District of Pennsylvania against Direct Tools & Fasteners Inc., alleging that the California corporation sells gloves under the same trade name as the one the plaintiff is using.

According to the complaint, the plaintiff alleges that Banom Inc. sustained damages to its business as the result of a similarly marked product being sold to consumers. The plaintiff holds Direct Tools & Fasteners Inc. responsible because the defendant allegedly sells gloves under the Terminator name, which the plaintiff has trademarked.

The plaintiff requests a trial by jury and seeks to permanently enjoin the defendant and its agents from further using the Terminator trademark, compensatory damages, treble damages, all profits, court costs, interest, statutory damages, and any further relief this court grants. The plaintiff is represented by Stanley H. Cohen and Salvatore Guerriero of Caesar Revise, PC in Philadelphia.
