Lawsuit: Medical center didn't protect man with dementia, resulting in lost testicle

PITTSBURGH — A man with dementia is suing The Pavilion at Bradford Regional Medical Center and Bradford Hospital, alleging negligence and liability in connection with an assault by a fellow nursing home resident that ultimately resulted in the amputation of a testicle.

The plaintiff, by and through his daughter and power of attorney, filed a complaint on Jan. 17 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging that they failed to provide adequate supervision to the plaintiff in order to prevent inappropriate contact by a fellow nursing home resident.

According to the complaint, the plaintiff alleges that he was assaulted by a fellow resident in an incident that ultimately necessitated the removal of one of his testicles. The plaintiff holds The Pavilion at Bradford Regional Medical Center and Bradford Hospital responsible because the defendants allegedly allowed a resident with a known history of inappropriate and aggressive behavior to have access to the plaintiff without safeguards.

The plaintiff requests a trial by jury and seeks compensatory damages, interest, delay damages, court costs and any further relief this court grants. He is represented by Sean P. McDonough and Patrick E. Dougherty of Dougherty, Leventhal & Price, LLP in Moosic.
