PHILADELPHIA — Ten pipeline workers have filed suit in federal court alleging violation of the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and the Pennsylvania Wage Payment Collection Law.
Chris Chambers, Daniel Wainwright, Gary Chapa, Tori Bailes, Ronald Denison, Jason Ayala, Chase Gadner, Kevin Cecil Sr., Kevin Cecil Jr. and Brennon Loftin filed a complaint on Jan. 16 in the U.S. District Court for the Western District of Pennsylvania against
SD Holdings LLC d/b/a Evolution Energy Services, Evolution Energy Chemical Company, Evolution Energy Incorporated, Evolution Energy Solutions LLC, Evolution Energy Pipeline LLC, Evolution Energy Services LLC, Evolution Energy Transportation & Supply LLC, Evolution Energy Trucking Company, Michael Slavik and Monte Pratt, alleging violation of wage laws.
According to the complaint, the plaintiffs allege that they worked on a pipeline project in Ohio, and that after initially receiving payment as agreed, they did not receive pay for work performed from mid-November to mid-December 2016. The plaintiffs hold the defendants responsible for alleged violations of wage laws in connection with failure to pay minimum wage, failure to pay proper overtime and failure to pay wages.
The plaintiffs request a trial by jury and seek benefits, back pay, wages, damages, liquidated damages, court costs and any further relief this court grants. They are represented by Ari R. Karpf and Timothy S. Seiler of Karpf, Karpf & Cerutti, P.C. in Bensalem.
