PITTSBURGH — A Pennsylvania company is suing Envirobusiness Inc., a Massachusetts corporation, citing alleged breach of contract and unjust enrichment.

Nexstara LLC filed a complaint on Jan. 17 in the U.S. District Court for the Western District of Pennsylvania against Envirobusiness Inc., alleging that the Massachusetts corporation refused to pay the plaintiff for changes to customize computer programming.

According to the complaint, the plaintiff alleges that it sustained damages to its business. The plaintiff holds Envirobusiness Inc. responsible because the defendant allegedly breached its contract with the plaintiff by failing to pay for services provided outside of the scope of work.

The plaintiff seeks a declaration that the work is not work made for hire and that the plaintiff owns the work, an injunction against the defendant, court costs, damages, and any further relief this court grants. The plaintiff is represented by John C. Thoas III of Beck & Thomas, P.C. in Pittsburgh.
