UPMC, others blamed for alleged failure to timely diagnose cancer

PITTSBURGH — A married couple's lawsuit against Juno E. Varghese, M.D.; Absolute Primary Care UPMC; University of Pittsburgh Physicians; and UPMC, alleges negligence in medical care.

David Kelly and Catherine Kelly filed a complaint on Dec. 6 in the Court of Common Pleas of Allegheny County against the defendants, alleging that they failed to evaluate the overall physical condition of David Kelly.

According to the complaint, the plaintiffs allege that David Kelly suffered due to a failure to timely diagnose liver cancer. The plaintiffs hold the defendants responsible for an alleged failure to interpret the results of David Kelly's liver biopsy and identify the early signs of liver cancer.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount that exceeds the jurisdictional limits of this court plus court costs and interest. They are represented by Harry S. Cohen and Todd D. Bowlus of Harry S. Cohen & Associates, PC in Pittsburgh.
