Couple seek up to $50K for alleged slip-and-fall at Wal-Mart

PHILADELPHIA – A Philadelphia couple have sued Wal-Mart for negligence, alleging it failed to provide a safe shopping environment at its Roosevelt Boulevard location in Northeast Philadelphia, which led to one of the plaintiffs falling and becoming injured.

Sonia and Jack Smith filed suit on Jan. 17 in the Philadelphia County Court of Common Pleas, against Wal-Mart Stores East, L.P. of Bentonville, Ark.

“On or about Nov. 4, 2015, Sonia Smith was lawfully shopping inside of the Wal-Mart store located on the aforementioned premises when, suddenly and without warning, and a direct result of a defective and/or dangerous condition of the premises, plaintiff slipped on oil located on the floor, thereby causing her to fall and sustain various severe and permanent bodily injuries and losses,” the lawsuit reads.

The plaintiffs say the defendant’s failure to clear the floor surface led to Sonia’s fall accident, and that she suffered injuries to her lumbar spine, hip and knees, among others, in the process.

Sonia is seeking damages not in excess of $50,000, while Jack is seeking an identical amount for loss of consortium.

The plaintiffs are represented by Brandon A. Swartz and Bryan M. Ferris of Swartz Culleton, in Newtown.
