Motorist alleges State Farm failed to pay benefits

PHILADELPHIA — An Orefield motorist is suing State Farm, alleging breach of contract.

Michelle Womer filed a complaint Jan. 26 in U.S. District Court for the Eastern District of Pennsylvania against State Farm Insurance Company, alleging refusal to pay benefits due the plaintiff.

According to the complaint, on April 30, 2016, Womer was involved in a violent vehicular accident and made claims for medical treatment but was refused any coverage. The plaintiff alleges State Farm breached its contractual agreement with Womer by refusing to pay claims for UIM benefits despite having sufficient medical records.

Womer seeks trial by jury, damages of more than $150,000, medical expenses and court costs. She is represented by attorney Thomas R. Yorko of Philadelphia.
