PITTSBURGH — Two consumers have filed a class action lawsuit against General Nutrition, alleging breach of contract.

Doug Cook of Atlanta and Jody Eberhart of Ligonier, Pennsylvania, filed a complaint, individually and on behalf of all persons similarly situated, Jan. 30 in U.S. District Court for the Western District of Pennsylvania against General Nutrition Corporation, alleging wrongful termination of their Gold Card program membership.

According to the complaint, in 2016, Cook and Eberhart suffered monetary damages from having their paid membership program terminated, including the benefits that comes with it. The plaintiffs allege General Nutrition stopped providing the benefits to its members that purchased the Gold Card program.

Cook and Eberhart seeks trial by jury, injunctive relief to honor all benefits and for the defendant to perform all obligations under the Gold Card program, court costs and all relief the court grants. They are represented by attorneys David D. Borkovic of Jones, Gregg, Creehan & Gerace, LLP in Pittsburgh, and by David M. Cohen of Complex Law Group LLC in Marietta, Georgia.
