Chester man alleges serious skin injuries were result of Belvedere Center's negligence

MEDIA – A Chester man says that a care facility he was admitted to nearly two years ago neglected to care for him via the orders that accompanied his arrival, which contributed to the worsening of a painful series of skin breakdown wounds and other injuries.

Steven Seals (through his powers of attorney Delores Driggins and Steven Tucker) of Chester filed suit on Jan. 13 in the Delaware County Court of Common Pleas, against The Belvedere; The Belvedere Center, Genesis Healthcare; The Belvedere Convalescent Home; The Belvedere, A Genesis-Crozer Keystone Health System Center; all of Chester, plus Genesis Healthcare, Inc. of Kennett Square and Genesis Healthcare Corporation of Harrisburg.

On May 8, 2015, the plaintiff was admitted to the defendant facility for skilled care transitioning to long-term care, subsequent to suffering a cocaine overdose, subdural hematoma and intracerebral hemorrhage with craniotomy – which left him alert but non-verbal, and immobile with contractures of the lower extremities while also being at high risk for skin breakdown.

When he was admitted, the plaintiff was suffering skin breakdown at the left buttock, left gluteal fold, right posterior thigh, right and left heels and right big toe. Admission orders were to use bilateral heel protector boots, pillows between knees and repositioning every two hours with the plaintiff, at all times. According to the complaint, these orders were not followed.

As the standard of his care allegedly continued to decrease in the next several months, according to the lawsuit, Seals sustained new skin breakdown wounds on his penis, scrotum, both knees and both ankles, before ultimately being transferred to another nursing facility on Jan. 1, 2016.

For charges of professional negligence related to vicarious and direct corporate liability, the plaintiff is seeking damages, jointly and severally, in excess of $50,000, plus interest and costs of suit.

The plaintiff is represented by Carin A. O’Donnell and Jordan S. Friter of Stark & Stark, in Yardley.
