Adult Day Services, Med Transit sued by customer

PHILADELPHIA – A Philadelphia woman is suing a transportation company and adult care facility, claiming she was seriously injured while in transit from her home to that same facility or at the facility itself.

Thelma Jenkins of Philadelphia filed suit on Feb. 2 in the Philadelphia County Court of Common Pleas, against Adult Day Services of Upper Darby and Med Transit, LLC of Philadelphia.

“On or about April 19, 2016, plaintiff [Thelma] Jenkins left her home at 2020 South 23rd Street, Philadelphia at approximately 9 a.m. to be transported by van by defendant Med Transit, LLC to defendant Adult Day Services’ aforementioned facility. At approximately 4:40 p.m., plaintiff was picked up at the facility by Med Transit, LLC staff and was transported home. Plaintiff returned home with a contusion to her head and swelling to her left knee,” the complaint reads.

“Defendants undertook no investigation to ascertain the cause of plaintiff’s severe injuries that were sustained under the care of the defendants at the aforementioned facility and/or in transit in Philadelphia and/or Delaware County. More specifically, plaintiff suffered a left leg fracture, blood clot, and cerebral concussion,” the complaint continues.

Jenkins claims the defendants failed to monitor her for fall and injury prevention, safely provide her transport or implement fall injury prevention measures, and to have sustained a left leg fracture, blood clot, and cerebral concussion.

For counts of negligence against both defendants, the plaintiff is seeking damages in excess of $50,000.

The plaintiff is represented by Christopher J. Culleton of Swartz Culleton, in Newtown.
