Legal funding group pursues legal fees litigation against Arizona attorney

PHILADELPHIA – A Philadelphia-based legal funding organization has initiated legal action against an Arizona attorney, claiming he breached a contract in which he was supposed to deliver part of his legal fees to the plaintiff.

Lawyers Funding Group filed suit on Feb. 2 in the Philadelphia County Court of Common Pleas, against Laurence M. Berlin of Tucson, Ariz.

“Seller entered into an “Account Receivable Sale and Repurchase Agreement” with LFG wherein defendant agreed to sell and LFG agreed to purchase a portion of seller’s interest in legal fees due to seller as a result of contingent fee agreements with his clients...wherein defendant sold and LFG purchased a portion of seller’s interest in his fees from the following matters: Baker v. Oro Valley Hospital, LLC Et.Al; Turner v. Pulmonary Associates of Southern Arizona Et.Al; Pima County Office of Children’s Counsel as Guardian Ad Litem for A.E., a minor v. State of Arizona, Et.Al; Reis v. Lawrence R. Cronin M.D. Et.Al and a matter not yet filed involving Marcus Crocket,” the suit says.

Activity in the Reis case showed it was settled on Jan. 11 and Berlin received some or all of the attorney’s fees, in alleged breach of the contract. The plaintiff argues due to the defendant’s conduct in the Reis matter, that he would do the same in the remaining cases rather than deliver the money to the plaintiff per the original agreement.

On a count of breach of contract, the plaintiff seeks $82,500; for conversion, in excess of $50,000 plus attorney’s fees; for anticipatory breach, an additional sum equal to the portion of the fees in the Baker matter, the Turner matter, the A.E. matter and the Crocket matter, sold and assigned to LFG plus liquidated damages and legal fees; plus a complete and timely accounting and reservation of the right to amend the complaint for a demand for accounting.

The plaintiff is represented by Alan R. Zibelman of Zibelman Legal Associates, in Philadelphia.
