H.J. Heinz Company Severance Pay Plan alleges man wrongly received payment

PITTSBURGH — Business fund operations are suing Jeffrey Cunningham, a former employee, citing alleged breach of contract.

H.J. Heinz Company Severance Pay Plan and Kraft Heinz Employee Benefits Administration Board filed a complaint on Feb. 1 in the U.S. District Court for the Western District of Pennsylvania against Cunningham, alleging that the former employee refused to repay plan severance benefits to the plaintiffs

According to the complaint, the plaintiffs allege that H.J. Heinz Company Severance Pay Plan and Kraft Heinz Employee Benefits Administration Board suffered damages to the Employee Retirement Income Security Act funds. The plaintiffs holds Jeffrey Cunningham responsible because the defendant allegedly failed to sign a general release required to receive the severance.

The plaintiffs seek judgment against the defendant in the amount of $31,457.12, interest, court costs and any further relief this court grants. They are represented by James S. Urban and Sarah L. Thompson of Jones Day in Pittsburgh.
