Permafloor accused of violating agreement by failing to pay contributions

PHILADELPHIA — Labor funds are suing Permafloor LLC, citing alleged breach of contract.

Cement Masons' Union Local No. 592 Pension Fund, Cement Masons' Union Local No. 295 Welfare Fund, Cement Masons' Union Local No. 592 Joint Apprenticeship Training Fund, General Building Contractors Association Inc. Industry Advancement Program, Cement Masons' Union Local No. 592 Political Action Committee, Cement Masons' Union Local 592 of Philadelphia, PA, and Bill Ousey filed a complaint on Feb. 8 in the U.S. District Court for the Eastern District of Pennyslvania against Permafloor LLC, alleging that the employer failed to make timely contributions per a collective bargaining agreement.

According to the complaint, the plaintiffs allege that they sustained damages due to unpaid and late paid contributions. The plaintiffs holds Permafloor LLC responsible because the defendant allegedly failed to remit payments for benefit contributions on behalf of employees.

The plaintiffs seek judgment against the defendant for contributions due and owing, liquidated damages, interest, court costs and any further relief this court grants. They are represented by Maureen W. Marra of Jennings Sigmond, P.C. in Philadelphia.
