Former CEO alleges denial of leave, wrongful termination

PHILADELPHIA — A former CEO is suing GoSend Inc., Transit Systems Inc. and Christopher Smith, the president of both companies, citing alleged retaliation, unpaid wages, violation of the Family and Medical Leave Act (FMLA) and violation of workers compensation acts.

Richard Rodgers of West Chester filed a complaint on Feb. 15 in the U.S. District Court for the Eastern District of Pennsylvania alleging that they interfered with plaintiff's rights to FMLA leave.

According to the complaint, the plaintiff alleges that he was terminated from his employment as CEO of GoSend for requesting for FMLA leave. The plaintiff holds the defendants responsible because they allegedly retaliated against the plaintiff for exercising his rights under FMLA.

The plaintiff requests a trial by jury and seeks back pay, lost wages, front pay, bonuses, monetary compensation and liquidated damages no less than $150,000, as well as court costs, interest and any further relief the court grants.
