Labor group seeks unpaid fringe benefits from construction contractor

Law money 08

PITTSBURGH — A Western Pennsylvania labor group is suing Juanton Williams, the owner of a construction flagging contractor, citing alleged breach of contract for withholding funds meant for employee fringe benefits.

Laborers' Combined Funds of Western Pennsylvania, acting on behalf of unions with which Williams' company had agreements, filed a complaint on Feb. 24 in the U.S. District Court for the Western District of Pennsylvania against Juanton Williams alleging that the employer failed to pay monthly benefit contributions to the Employee Retirement Income Security Act fund.

According to the complaint, the plaintiffs allege that they sustained damages due to unpaid and late paid benefit contributions. The plaintiffs hold Juanton Williams responsible because he allegedly failed to make fringe benefit contributions on behalf of their employees.

The plaintiffs request a trial by jury and seek judgment against the defendant of all benefits owed plus interest and court costs. They are represented by Jeffrey J. Leech and Neil J. Gregorio of Tucker Arensberg P.C. in Pittsburgh.
