US Foods says Pittsburgh Athletic Association failed to pay nearly $40,000 for deliveries

PITTSBURGH — An Illinois food wholesaler is suing the Pittsburgh Athletic Association and David M. Bruce, citing alleged breach of contract for failing to pay for food delivered to it.

US Foods Inc. filed a complaint on Dec. 19 in the Court of Common Pleas of Allegheny County against the defendants alleging that they failed to pay the plaintiff for the food products they ordered.

According to the complaint, the plaintiff alleges that US Foods sustained financial damages from not being paid. The plaintiff holds the defendants responsible because they allegedly made a partial payment of just over $1,000 to the plaintiff but failed to pay the total agreed price of nearly $40,000. Bruce is listed as the guarantor for the debts.

The plaintiff seeks judgment against the defendant in the amount of $39,103.32 plus interest at the rate of 1.5 percent per month, plus 30 percent attorney's fee and court costs. They are represented by David K. McMullin of McMullin Law Group LLC in Pittsburgh.
