Medical coding company charged with sending unsolicited fax advertisements

PHILADELPHIA — A doctor has filed a class action lawsuit against Optum360 LLC, a Minnesota company, citing alleged violation of telephone harassment statutes.

Robert W. Mauthe, who runs a private medical practice in Center Valley, filed a complaint on behalf of all others similarly situated on March 1 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the defendants sent fax advertisements for medical coding products to the plaintiff.

According to the complaint, the plaintiff alleges that he sustained damages from receiving advertisements on his fax machine. The plaintiff holds Optum360 responsible because it allegedly sent unsolicited fax messages to the plaintiff without prior consent, a violation of privacy.

The plaintiff seeks damages, punitive damages, court costs and any further relief the court grants. He is represented by Richard Shenkan of Shenkan Injury Lawyers LLC in New Castle.
