PHILADELPHIA — The U.S. Department of Labor is bringing a lawsuit against Osaka Japan Restaurant Inc. d/b/a Osaka; J.H.S.K. Inc. d/b/a Osaka; Kwang Bum Kim; and James Kim, restaurant operators, citing alleged unpaid wages, violation of applicable minimum wage law and violation of workers compensation acts.

Edward C. Hugler, acting Secretary of Labor, filed a complaint on March 8 in the U.S. District Court for the Eastern District of Pennsylvania against the operators of the Osaka restaurant location in Lansdale alleging that they failed to provide proper compensation to the plaintiffs.

According to the complaint, the plaintiff alleges that he sustained damages on behalf of the employees that were not adequately compensated for their work. The plaintiff holds Osaka Japan Restaurant and other defendants responsible because they allegedly failed to compensate their employees, including keeping an accurate record of their employees' total working hours.

The plaintiff seeks to enjoin the defendant, as well as seeks unpaid minimum and overtime compensation, liquidated damages, court costs and any further relief the court grants. The Labor Department is represented by Brian P. Krier of the Office of the Solicitor, Region III in Philadelphia.
