Nurse's assistant alleges failure to pay overtime by Colonial Park Care, files class action

SCRANTON — A nurse's assistant has filed a class action lawsuit against Colonial Park Care Center LLC d/b/a Colonial Park Care Center, citing alleged unpaid wages, violation of applicable minimum wage law and violation of workers compensation acts.

Daaiyah Shabazz of Harrisburg filed a complaint on behalf of those similarly situated on March 10 in the U.S. District Court for the Middle District of Pennsylvania alleging that the employer failed to compensate the plaintiff for her work.

According to the complaint, Shabazz alleges that she was not paid any overtime or minimum wages during her employment. The plaintiff holds the defendants responsible because they allegedly allowed the plaintiff to work more than 40 hours per week without paying any overtime compensation. The complaint estimates the number of class members of the suit to be at least 40.

The plaintiff requests a trial by jury and seeks compensation, reimbursement, all benefits, liquidated damages, court costs and any further relief the court grants. She is represented by Matthew D. Miller, Justine L. Swidler and Richard S. Swartz of Swartz Swidler LLC in Cherry Hill, New Jersey.
