Brewpub claims competing establishment advertises under too-similar name

PITTSBURGH - A Pittsburgh brewery is suing Stone Church Pizza & Brewpub LLC, citing alleged unfair competition for advertising under similar names.

Lawrenceville Brewery Inc. filed a complaint March 10 in the U.S. District Court for the Western District of Pennsylvania alleging the defendant advertises its services under a mark similar to the plaintiff's mark of The Church Brew Works. The defendant markets under the mark Stone Church Brewpub, which the plaintiff argues is confusing as the defendant is only a 70-mile drive from the plaintiff. Lawrenceville Brewery has sent notice to change the defendant's advertising mark.

According to the complaint, the plaintiff alleges it sustained damages to its business as well as its reputation from the unfair marketing actions of the defendant. The plaintiff holds the defendant responsible because it continues to use the Stone Church Brewpub moniker, which confuses consumers.

The plaintiff requests a trial by jury and seeks to enjoin the defendant, as well as all profits, statutory damages, treble damages, punitive damages and any further relief the court grants.
