SCRANTON, Pa. - A Pennsylvania home warranty company is suing Taylor Morrison of Georgia LLC, citing alleged breach of contract.
Quality Builders Warranty Corp. filed a complaint March 29 in the U.S. District Court for the Middle District of Pennsylvania alleging the defendant failed to enroll all of its constructed homes in its warranty program according to the builder agreement.
According to the complaint, the plaintiff alleges it sustained damages due to the breach of its builder agreement with the defendant. The plaintiff holds Taylor Morrison of Georgia responsible because it allegedly sent a notice of termination of its membership to the plaintiff, which is in violation of the builder agreement.
The plaintiff requests a trial by jury and seeks for the defendant to enroll all homes it constructs with the builder agreement and pay damages equal to warranty fees in an amount that exceeds $75,000 plus interest, court costs and any further relief the court grants. The plaintiff is represented by John A. Gill of Wormleysburg.
