SCRANTON, Pa. - A Lebanon corporation is suing ICT Organics LLC, based in Baltimore, citing alleged copyright infringement and unfair competition for using identical marks on a product it sells.
Lebanon Seaboard Corporation filed a complaint March 30 in the U.S. District Court for the Middle District of Pennsylvania alleging the defendant uses the mark "PREEM" on the labels of its herbicides. Both companies' products in question are herbicides.
According to the complaint, the plaintiff alleges Lebanon Seaboard sustained damages to its business from having its mark used on others' products. The plaintiff holds ICT responsible because it allegedly caused confusion among consumers by using the same mark on its herbicides.
The plaintiff requests a trial by jury and seeks to enjoin the defendant, profits, damages, seizure of all infringing materials, court costs and any further relief the court grants.
