Woman claims Heart II Heart retaliated for refusal to falsify information to state and federal agencies

PITTSBURGH — An employee is suing Heart II Heart LLC, a caregiving group for people with disabilities, citing alleged retaliation, unpaid wages and violation of Workers' Compensation acts.

Crystal Waits filed a complaint on Dec. 19 in the Court of Common Pleas of Allegheny County alleging that the defendant, based in Verona, terminated the plaintiff as retaliation for refusing to falsify information to be submitted to state and federal agencies.

According to the complaint, the plaintiff alleges that she was terminated from her employment for refusing to participate in an illegal act. The plaintiff holds Heart II Heart responsible for the retaliatory action and because the employer allegedly improperly classified the plaintiff as an independent contractor in order to avoid paying her adequate overtime wages.

The plaintiff requests a trial by jury and seeks front and back pay, unpaid overtime wages, punitive damages, interest, court costs, compensatory damages and any further relief this court grants. She is represented by Kayla Drum of Kraemer, Manes & Associates LLC in Pittsburgh.
