Sheet Metal Workers group says contractor delinquent in making union payments

PHILADELPHIA — A local union has filed a class action lawsuit against Accurate Sheet Metal LLC, a contractor, citing alleged breach of contract.

Sheet Metal Workers' Local 19, its relevant benefit funds and Gary Masino, the group's trustee, filed a complaint on April 5 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the Pennsylvania employer failed to remit certain payments to the workers' union.

According to the complaint, the plaintiffs allege that its organization and employees represented sustained damages as the result of the delinquent payments. The plaintiffs hold Accurate Sheet Metal responsible because it allegedly failed to pay the amounts due to the plaintiff based on their bargaining agreement.

The plaintiffs seek judgment in the total amount delinquent, interest, audit costs, injunctive relief, liquidated damages, court costs and any further relief this court grants. They are represented by Nicholas J. Botta of Spear Wilderman P.C. in Philadelphia.
