Son sues medical transport company for father's death en route to Philadelphia

PHILADELPHIA — An estate administrator is suing Air Critical Care LLC d/b/a ACC Medlink, a Florida company, alleging insufficient measures were taken to prevent injuries and negligence.

Yale S. Popowich, as co-administrator of the estate of David M. Popowich, deceased, filed a complaint on April 26 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the defendant failed to provide proper medical care to David Popowich while he was being transported from one medical facility to another.

According to the complaint, the plaintiff alleges that David Popowich suffered serious injuries while under the care of the defendant. The plaintiff holds the defendant responsible because it allegedly failed to provide adequate oxygen to David Popowich, who was oxygen-dependent, while it was transporting him from Florida to Philadelphia.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that exceeds $50,000 plus interest and court costs. He is represented by Thomas R. Kline and Regan S. Safier of Kline & Specter P.C. in Philadelphia.
