Center Valley doctor says Maryland company sent unsolicited faxes

PHILADELPHIA — A doctor has filed a class action lawsuit against National Imaging Associates Inc., a Maryland corporation, citing alleged violation of telephone harassment statutes for their sending of unwanted faxes.

Robert W. Mauthe, a doctor based in Center Valley, filed a complaint on behalf of all others similarly situated on April 26 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the plaintiff sent unsolicited advertisement faxes to the plaintiff.

According to the complaint, the plaintiff alleges that he was damaged from receiving unsolicited fax messages advertising the defendant's website www.RadMD.com. The plaintiff holds National Imaging Associates responsible because the defendant allegedly failed to include an opt-out option to the fax messages they sent the plaintiff.

The plaintiff seeks damages, punitive damages, court costs and any further relief this court grants. He is represented by Richard Shenkan of Shenkan Injury Lawyers LLC in New Castle.
