ERIE — A Pennsylvania cutlery seller is suing Roadsideimports LLC, a Colorado company, citing alleged unfair competition for using the plaintiff's trademark on its products.

W.R. Case & Sons Cutlery Company and CaseMark Inc., of Bradford, filed a complaint on April 27 in the U.S. District Court for the Western District of Pennsylvania against Roadsideimports alleging that it used plaintiff's trademarks on their products without authority.

According to the complaint, the plaintiffs allege that they sustained damages to their businesses and reputations. The plaintiffs holds the defendant responsible because it allegedly sells knives that have plaintiff's trademarks, which damaged plaintiff's reputation.

The plaintiffs request a trial by jury and seek treble damages, enhanced damages, punitive damages, permanent injunction, court costs, interest and any further relief this court grants. They are represented by David S. Elkins and Joseph P. Grasser of Squire Patton Boggs LLP in Palo Alto, California.
