Clark Capital says Minnesota insurance firm used its trademark to advertise

PHILADELPHIA — A Philadelphia financial services company is suing RiverSource Life Insurance Company, based in Minnesota, citing alleged unfair competition for using its trademark.

Clark Capital Management Group Inc., filed a complaint on May 16 in the U.S. District Court for the Eastern District of Pennsylvania against RiverSource alleging that it used plaintiff's Navigator mark to advertise its services.

According to the complaint, the plaintiff alleges that it was damaged from having its mark used by a competitor. The plaintiff holds the defendant responsible because it allegedly continued to use the plaintiff's mark despite receiving up to six notices to cease using it.

The plaintiff requests a trial by jury and seeks injunction against the defendant from further infringing plaintiff's trademark, destruction of all infringing materials, payment of all damages to the plaintiff, compensatory, incidental and consequential damages, enhanced, treble and punitive damages, court costs and any further relief this court grants.
