Action Pak allegedly fired employee while he sought treatment for torn Achilles

PHILADELPHIA — A Fairless Hills man is suing Action Pak Inc., alleging violation of the Family and Medical Leave Act.

Ned Cutshall filed a complaint on May 15 in the U.S. District Court for the Eastern District of Pennsylvania alleging that Action Pak, based in Bristol, terminated his employment after he went on an FMLA-protected leave.

According to the complaint, the plaintiff alleges that he was damaged from being terminated from work for going on leave to address a torn Achilles tendon. The plaintiff holds the defendant responsible because it allegedly terminated plaintiff's employment as retaliation for exercising his rights to FMLA.

The plaintiff seeks reinstatement, all wages and benefits, interest, liquidated damages, court costs and any further relief this court grants. He is represented by Patricia C. Collins of Antheil Maslow & MacMinn LLP in Doylestown.
