PHILADELPHIA — A former home health aide has filed a class action lawsuit against Always Best Care, alleging violations of minimum wage law and Workers' Compensation acts.

Matilde Griggs filed a complaint on behalf of other similarly situated on May 31 in U.S. District Court for the Eastern District of Pennsylvania alleging that the employer failed to properly compensate the plaintiff.

According to the complaint, the plaintiff alleges that she was damaged from not being paid proper wages during her employment. The plaintiff holds Always Best Care responsible because it allegedly failed to pay overtime wages to the plaintiff for hours worked in excess of 40 per week; plaintiff alleges that she often worked 70 or more hours per week and only received flat pay for that time instead of time-and-one-half.

The plaintiff requests a trial by jury and seeks damages from unpaid wages, unpaid overtime wages, liquidated damages, court costs, interest and any further relief this court grants. She is represented by Adam Peavy of Bailey Peavy Bailey Cowan Heckaman PLLC in Houston.
