Ironworkers union says R & B Steel failed to send along employee withholdings

ERIE — A union is suing R & B Steel & Rebar LLC c/o William J. Rogers, alleging breach of contract.

Ironworkers Local 549/550, and its fringe benefit fund and administrator, filed a complaint on June 7 in U.S. District Court for the Western District of Pennsylvania against the defendants alleging that the West Mifflin contractor failed to remit employee withholdings to the labor group.

According to the complaint, the plaintiff alleges that its organization and fund was damaged due to the unpaid contributions. The plaintiff holds the defendants responsible because they allegedly failed to make timely fringe benefit contributions on behalf of their employees.

The plaintiff seeks judgment of of $18,974.47 plus liquidated damages, permanent injunction, interest, court costs and any further relief this court grants. They are represented by Jeffrey R. Bruno, Thomas J. Griffith and Timothy P. Piatt of Macala & Piatt LLC in North Canton, Ohio.
