Universal Electric Corp. files false advertising suit against former sales rep

ERIE – A manufacturer of products for the electrical power distribution industry alleges that a former sales representative is engaging in wrongful competitive actions.

Universal Electric Corp. filed a complaint on June 26 in the U.S. District Court for the Western District of Pennsylvania against Mark H. Baldwin, Baldwin Technologies Inc., Busway Solutions LLC, Direct  Power Technologies Inc. and Engineered Products Co., doing business as PDU Cables, alleging false advertising, breach of contract and other counts.

According to the complaint, Baldwin Technologies Inc. through defendant Baldwin was a sales representative for the plaintiff for more than 15 years. The plaintiff alleges that when Baldwin was terminated, he filed provisional U.S. patent applications for the products he represented for the plaintiff under the name of his company Busway Solutions. The plaintiff also alleges that the defendants used false and misleading advertising.

The plaintiff requests a trial by jury and seeks injunctive relief against the defendants, profits and monies, restitution and disgorgement of monies, compensatory damages, interest, court costs and any further relief the court grants.
