Surgeon accuses Depuy Synthes Cos., others of patent infringement

PHILADELPHIA – A Las Vegas orthopaedic surgeon alleges that a West Chester-headquartered company is manufacturing products that use his patented technology.

Dr. Mark A. Barry filed a complaint on July 5 in the U.S. District Court for the Eastern District of Pennsylvania against Depuy Synthes Cos., Depuy Synthes Products LLC and Depuy Synthes Sales Inc. alleging patent infringement.

According to the complaint, the plaintiff alleges that he was damaged as the result of his patents, which deal with aligning vertebrae, being infringed. The plaintiff holds Depuy Synthes Cos., Depuy Synthes Products LLC and Depuy Synthes Sales Inc. responsible because the defendants allegedly manufactured and sells medical devices that infringe several of plaintiff's patents.

The plaintiff requests a trial by jury and seeks damages adequate to compensate the plaintiff, treble damages, interest, compensatory damages, court costs and any further relief the court grants. He is represented by John S. Stapleton and Jonathan L. Cochran of Hangley Aronchick Segal Pudlin & Schiller in Philadelphia.
