Woman with brain injury caused by baseball alleges LINA wrongfully terminated benefits

ERIE – A Philadelphia woman alleges that her long-term disability benefits were wrongfully terminated.

Wendy Camlin filed a complaint on July 5 in the U.S. District Court for the Western District of Pennsylvania against Life Insurance Co. of North America, doing business as Cigna Group Insurance, alleging breach of fiduciary duty.

According to the complaint, the plaintiff alleges that she suffered a traumatic brain injury when she was struck in the head by a baseball during a Pittsburgh Pirates game in April 2015 and began receiving long-term disability benefits in December 2015. The suit states the defendant terminated her benefits in February 2017.

The plaintiff holds Life Insurance Co. of North America responsible because the defendant's denial of disability benefits is illegal and unreasonable.

The plaintiff seeks all benefits due and owing, court costs, punitive damages, and any further relief the court grants. She is represented by Mark Gordon, Paul K. Vey and Peter W. Nigra of Pietragallo Gordon Alfano Bosick & Raspanti LLP in Pittsburgh.
