New Dominion Construction alleged to owe more than $200,000 for construction work

PITTSBURGH – An Alabama company alleges a McDonald construction company still owes it for work it did on a project.

Synergy Earth Systems LLC filed a complaint on July 20 in the U.S. District Court for the Western District of Pennsylvania, Pittsburgh Division against New Dominion Construction Inc., Michael C. Pascuzzi and Nicholas A. Pascuzzi III alleging breach of contract, unjust enrichment and other counts.

According to the complaint, the plaintiff was hired as a subcontractor for the defendants in August 2016 for some construction work. The plaintiff alleges it completed the work but that the defendants have failed to pay for all of its work. It alleges it is still owed $297,511.25.

The plaintiff seeks judgment against the defendant in an amount that exceeds the principal amount of $297,511.25 plus court costs, interest, punitive damages and any further relief the court grants. It is represented by Richard W. Saxe Jr. and Marc J. Felezzola of Babst, Calland, Clements & Zomnir PC in Pittsburgh.
